Title might be a bit rage-bait-y, because it looks like spectrum squatting:

While yes use it or lose it, 40 total MHz at 2 GHz is reasonably narrow.

Use it or lose it is fair game with spectrum especially when your carve out is HUGE and your actual use/offerings fail to actually benefit anyone.
