The most interesting thing about this statement is probably the fact that they felt it was neccesary to make such a statement.

Right? Very much a vibe of, "Your mother and I wanted to let you know that we'll be talking about our relationship soon. But we want you to know that we'll always love you."

I don't know what that means, but also was that ever a concern I should have had before?

What’s the point of making the statement? Avoiding legal or regulatory consequences for anti competitiveness or for the exploitation of tax free growth as a nonprofit?

Not completely the same. On OpenAI‘s site it begins with "OpenAI and Microsoft" and on Microsoft‘s with "Microsoft and OpenAI" :)

Microsoft has tentatively agreed to invest $100B+ into OpenAI's corporate arm. There is not yet a firm, binding agreement. OpenAI says it will remain a nonprofit + public benefit corporation and describes itself as a "philanthropic organization." They're soliciting applications for a $50M pool of grants for things like AI education and "community innovation."
